Terms of Use
These Terms of Use (the "Terms") govern access to and use of the CreateYourVPN website, partner dashboard and platform (together, the "Service"), operated by the operator of the CreateYourVPN platform (the "Operator", "we", "us"). Please read them carefully. If you do not agree, do not use the Service.
1. Definitions
"Partner" (or "you") means the person or entity that registers for or uses the Service. "Partner Servers" means the servers you own or rent and connect to the Service. "End User" means a customer of a Partner who uses a service the Partner builds on the platform. "Balance" means the prepaid funds credited to your platform account. "Pro" means an optional flat-rate platform subscription charged from your Balance.
2. Acceptance and eligibility
By registering for, accessing, using or paying for the Service you agree to these Terms, together with our Privacy Policy and Public Offer, which are incorporated by reference. You must be at least 18 years old and have the legal capacity to enter into a contract. If you use the Service on behalf of an organisation, you represent that you are authorised to bind it. The Service is intended for business (B2B) use by Partners, not for consumers.
3. Nature of the Service
The Service is a software-as-a-service tool for deploying and managing VPN software on Partner Servers. The Operator does not own or control the Partner Servers, is not a telecommunications operator, internet service provider or consumer VPN provider, and is not a party to the relationship between a Partner and that Partner’s End Users.
Any VPN service a Partner offers to its End Users is the Partner’s own product, provided by the Partner on the Partner’s own infrastructure and under the Partner’s own terms. The Operator merely provides the software that helps the Partner run it.
4. Your account
Sign-in uses one-time codes sent to your email address. You are responsible for keeping access to your email and account secure and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorised use.
5. Partner obligations and compliance
You are solely responsible for operating your service lawfully. In particular, you agree that you will:
- comply with all laws that apply to you and to your End Users, including any regulation of VPN or encryption services in the relevant countries, data-protection and consumer-protection laws, and tax obligations;
- maintain your own legal documents (such as terms and a privacy policy) for your End Users, as required by applicable law;
- only connect and use servers that you are lawfully entitled to control;
- not use, and not permit your End Users to use, the Service or your VPN for any unlawful purpose — including fraud, unauthorised access to systems, distribution of malware, child sexual abuse material, spam, or circumvention of sanctions;
- take responsibility for the acts and omissions of your End Users as if they were your own.
6. Acceptable use of the platform
When using the platform itself you must not attack, overload, probe or disrupt it or its infrastructure, circumvent billing or usage limits, or reverse-engineer the Service except to the extent that applicable law expressly permits despite this restriction.
Reselling VPN access to your own End Users is the intended use of the Service and is permitted. Reselling or providing access to the platform itself to third parties is not permitted without our prior written consent.
7. Fees, payments and no refunds
The Service operates on a prepaid Balance. Charges are applied according to the tariffs shown in the dashboard at the time of the charge; the Pro subscription is charged from your Balance. Prices may change on a going-forward basis, with notice. You are responsible for any taxes applicable to you.
All payments are final and non-refundable to the maximum extent permitted by law. Top-ups of your Balance are non-refundable and cannot be cashed out. Any unused Balance is not refunded on termination, including termination for breach. Because the Service is a digital service supplied immediately, you request that supply begins at once and, to the extent permitted by applicable law, acknowledge that you lose any right of withdrawal once supply has begun.
8. Suspension and termination
We may suspend or terminate your access if you breach these Terms, use the Service unlawfully, allow your Balance to reach zero (in accordance with the billing rules), or pose a risk to the platform or others. You may stop using the Service and close your account at any time. No refunds are due on termination. Deletion of data following termination is handled as described in the Privacy Policy.
9. Availability and "as is" service
The Service is provided "as is" and "as available", without warranties of any kind, and without any service-level guarantee, to the maximum extent permitted by law. The Service depends on third parties (such as hosting providers, payment providers, Telegram and DNS providers) whose availability we do not control. Network blocking or censorship of protocols in a given country is outside our control. We may perform maintenance that temporarily affects availability.
10. Limitation of liability
To the maximum extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us in the three (3) months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Indemnification
You agree to indemnify and hold harmless the Operator from and against any claims, damages, liabilities and expenses arising out of your servers, your service, your End Users, your content, or your breach of these Terms or of applicable law.
12. Intellectual property
The platform, including its software, design and brand, belongs to the Operator or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. Open-source components are provided under their own licences. You retain rights to your own content and data.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "last updated" date, and where changes are material we will provide notice through the dashboard. Your continued use of the Service after an update means you accept the revised Terms.
14. Governing law and disputes
These Terms are governed by the laws of the country in which the Operator is established, without regard to conflict-of-laws rules. Before starting any formal proceedings, you agree to first contact us through the support form so we can try to resolve the matter. Any dispute that cannot be resolved will be subject to the competent courts of the Operator’s place of establishment, to the extent permitted by applicable law.
15. Miscellaneous
These Terms, together with the Privacy Policy and the Public Offer, are the entire agreement between you and the Operator regarding the Service. If any provision is held unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. Neither party is liable for failure to perform due to events beyond its reasonable control (force majeure).
16. Language
This document may be provided in several languages for convenience. The English version is the governing text; in the event of any conflict or discrepancy, the English version prevails.
